Rental Terms and Pricing *

This agreement is between you the Renter, and David Beery (DBA: Dave's Island Instruments/Dii). Rentals are charged on a rent-to-rent monthly basis. Automatic monthly rental payments are made via PayPal Subscriptions. Rent-to-own payment plans are not offered. However, Dii will allow three months of rental fees to be used toward the purchase of a new instrument. David Beery/Dave's Island Instruments/Dii reserves the right to ask the Renter to return the Property at the end of any rental period for any reason.

Automatic Payments (Subscription) via PayPal *

A PayPal account is required to rent a Dii instrument for more than one month. Automatic payments can be made via your credit/debit card associated with your PayPal account. PayPal will manage the automatic monthly rental payments. PayPal calls this service a Subscription. You will receive email notifications each time a monthly payment is completed. If you don’t already have a PayPal account it is easy to create one in just a few steps once you click the Proceed to PayPal button during Dii shopping cart checkout. Simply enter your credit/debit card info, create a password, and click the Create and Subscribe button. Your monthly Subscription (rental) payments will be listed on your credit/debit card statement as PayPal*DAVESISLAND. You can change your payment methods or cancel the Subscription via PayPal. Login to PayPal with your computer (not a smart phone), click on Help, and enter "Subscriptions". If you have not returned the Property to David Beery (DBA: Dave's Island Instruments/Dii), 4115 Los Coyotes Diagonal, Lakewood, CA 90713 upon the expiration of the initial rental period (first month) this rental automatically renews at the beginning of each successive monthly rental period and you agree to pay the automatic monthly rental fee for each renewed rental period.

Proper Use *

The instrument should be played only as the owner intends for it to be played. HANDPANS should only be played gently with hands or gloved hands. Items such as: drum sticks, metal or plastic rods, xylophone or marimba mallets, marbles, etc., should NOT be used to produce sounds on this instrument. STEEL DRUMS should be played with wood or aluminum dowel mallets with latex rubber tips only. During transportation, HANDPANS and/or STEEL DRUMS should not be placed on top of or underneath any other item that may cause damage to the instrument. It is best that the instrument be placed in a padded cardboard box, or covered with a blanket or soft cloth when being transported without a case. Do not compress or squeeze a HANDPAN or STEEL DRUM. The notes are sensitive to compression and can be dented or put out of tune if another object (body/suitcase/guitar/car door/etc) is squeezed tightly against, on top of, or around it. Do not place the HANDPAN upside down inside or outside of a backpack, gig bag, or case. Be sure to always set the handpan down with the playing surface facing upward. The Gu hole should be facing down. When the STEEL DRUM is not on on its stand, it should always be placed upside down with the bowl side projecting upward. Do not set it on its side or on the bowl. Make sure the pan straps are securely mounted on the stand before playing. The HANDPAN and/or STEEL DRUM should not be played for prolonged periods in direct sunlight. Direct sunlight can unevenly heat the instrument and put the notes out of tune. The renter will be charged a tuning fee of $65.00/hour for steel drums and/or handpans, if any damage is caused to the instrument due to misuse or accident, which causes the drum to sound differently from when it was released from the owners possession.

Delinquent Accounts/Lost, Stolen, Destroyed Instruments *

Delinquent accounts in excess of one full rental period (one month) breach the rental agreement and all stated options. Instrument outfits must be returned, and all past due rental fees, penalties, and damage to instrument or accessories must be paid by rental customer. If you fail or refuse to comply with this requirement, you agree to pay the costs incurred in taking possession to include but not exclusive of outstanding rental fees, court costs, and attorney fees to the extent permitted under state law. If Dave's Island Instruments (Dii) turns the account over for collection, or files suit for return of instrument or payment of past due rent and/or damage to the instrument, rental customer agrees to pay all collection fees, attorney’s fees, and court costs, in addition to rental fees, penalties, and damages. Criminal Theft charges may be filed with the police on accounts in breach of contract if instruments are not paid for and/or returned.

A $1,500.00 fee will be charged for the replacement of a Handpan or Steel Drum if it is lost, stolen, or destroyed by accident, unforeseen circumstance, or otherwise, while in the care of the Renter. $100 for a replacement handpan bag, $100.00 for a replacement steel drum stand, $40.00 for a replacement handpan hard hat, $10.00 for replacement mallets.

Instrument Return/Right to Cancel *

The Renter is responsible for returning the rental Property to Dii and cancelling their PayPal rental subscription. If you do not renew this agreement or if you breach this agreement, David Beery (Dii/Dave's Island Instruments) has the right to repossession of the Property. If this happens, you agree to return the Property to 4115 Los Coyotes Diagonal, Lakewood, CA 90713. All shipping costs must be paid by the Renter. Any theft, loss, or damage during shipping is the liability of the Renter.

Cancelling your PayPal Subscription: You can manage or cancel your PayPal Subscription payments three ways. 1) Call PayPal at 1-888-221-1161 and ask about your Subscriptions. 2) Login to your PayPal account from your computer, click on Help, enter Subscriptions, click Search. 3) Login to your PayPal account from your computer, click on Settings (the little gear icon) > Payments > Manage Automatic Payments.

Final Notice *

By clicking this checkbox, you acknowledge that you have read and agree to the terms of this rental contract, you hereby agree that you have reviewed the renter's agreement, understand the proper use and maintenance of the instrument, and you promise to pay the agreed rental amount at the times agreed to above.
